Nashville Law Against Renting Homes May Be Unconstitutional

A Germantown couple is suing Metro Nashville government, saying its Airbnb ordinance is unconstitutional.

When Rachel Anderson’s husband, a traveling musician, was playing out of town, the Andersons started renting out their home on Airbnb. The money from the rental helped them cover the mortgage.

“Airbnb has really changed our lives to travel together as a family,” Anderson said.

When the couple realized they might need to move, they applied for a rental permit. They were denied due to a Metro ordinance saying non-owner-occupied rentals are limited to 3 percent of a zoned area.

The Beacon Center’s new litigation center has stepped in on the couple’s behalf.

“The Andersons are in a bind,” said Brandon Boucek, a lawyer with the Beacon Center. “The decisions about career, finance and family are kitchen table discussions. They should be the only ones at the table. Instead, Metro Nashville has given themselves a seat at the table where they have no business being.” (continue reading at WSMV)
